The end of the first volume concludes

3. About Bilibili video and up master

"Isn't the plot of this book just a pen-written version of the up videos from Station B? So, does this count as infringement?"

This is a question raised by a book friend before.

His attitude is relatively good, and it happens that this matter is within the plan summarized at the end of the volume, so I will explain it formally:

1.Bilibili video is not the main body of this book

If I had just used a pen to write down the video of the up owner, there would never be a book like this.

I hope everyone can rationally distinguish the differences in expression between "video" and "website".

Many videos look interesting and interesting, but when it comes to writing, I can only write a few sentences.

For example, for a handmade video, it is impossible for the up owner to show you the original video that lasts for several hours or even more than ten hours, so as a viewer, I don’t know what exactly happened during the production process.

The details and daily life here are not as simple as "writing out the video of the up owner of station B with a pen".

What equipment was used behind the scenes, how long it took, the editing ideas, and other things encountered during the process... these cannot be known just by watching their videos.

Especially the dog-food interaction between the male and female protagonists, it really has nothing to do with the video of the up owner.

The content of the dog food section accounts for the largest number of words in this book.

2. Infringement related

I actually didn’t think much about the issue of copyright infringement when I first started writing the book.

At that time, because school was about to start, this book was written about pen practice. I had been reading it for a long time, and I thought I could write it down slowly if I could get an initial order of 200. I really didn’t think about whether it would infringe or not.

Recently, I have learned a little bit about this aspect of knowledge. What I say below may not be correct. If there are book friends who know this aspect of legal knowledge, you can mention it in this chapter.

First of all, the most common way to infringe a video is to directly transfer the video content, publish it on another video website and mark it as original.

Then, using the same subject matter, the same copywriting and editing techniques, by replacing the characters and scenes in the video, a video that is basically the same as the original video but with a different shell is restored.

Among them, it is difficult to be judged as infringement simply by talking about the subject matter. For example, "Don't Challenge", which was very popular on Bilibili, has been imitated and followed by many people, but the specific content is different, so it is difficult to say that it is an infringement. At most, it is just an infringement.

It can be regarded as a reference.

As for the act of converting video content into text like this book, if you want to determine it as infringement, you need to make a more detailed judgment. It is definitely not the next "use a pen to write out the video of the up owner" judgment.

Simple.

In addition, in fact, the content borrowed from the book is more from the barrage in the video and the comments of shady netizens in the comment area.

As for whether the barrage and comments belong to the rights and interests of the video itself, I am not very clear about the legal judgment on this point.

3. Concrete analysis, look at it one by one

In the early stage of this book, the original video of "The Talented and Learning-Based Cai Qian" was borrowed. In it, the silver-embedded bracelet was only mentioned verbally and did not involve the video itself.

The second is a video on the transformation of rice cards, the production process is omitted, and some of the comments are borrowed from the comments in the video's comment area.

Then comes "Explainer, Flashing Light, Dark Chaser", which is based on Cai Qian's "Sword of the Night Sky" video. Because the swords produced are not the same, and the last two swords are only mentioned in one sentence in the article, so here

What I use is reference.

Among them, the content of Chapter 24 "Expositor Video Barrage Collection", as far as my personal subjective judgment is concerned, is indeed suspected of infringement, because when I first wrote it, I did watch the video of "Sword of the Night Sky" and

Written on the barrage.

Next is the Thousand Blades of the Demon Knife. Since I don’t understand the principle of glue dispensing, the terms and steps used in the production process came from the popular science of a netizen in the video comment area.

The disassembly of the small silver medal was based on a video of the up owner "Trapped". There was no detailed process, but the message in the comment area of the video was borrowed.

Then there are the bag chairs and umbrella chairs, which are inspired by the "handmade" crutch chairs.

The Zangetsu, Tensuo Zangetsu, Kyon's mask and cos in the Bleach series are magically modified based on the Tensuo Zangetsu video produced by the up owner "The Bottom of Hibernation".

The ink eyebrows that are still being produced are from the ink eyebrow video of the up owner "Xucheng Handan City Lord".

And the mini piano is an original video.

The above is the source description of the video of the male protagonist Chen Wen.

Next is the heroine Jiang Qiuyi, who basically comes from the up owner "Fei Fei", but the copyright of the song itself does not belong to her, including the characters she cosplays, the copyright does not belong to her, so is there any infringement involved?

The problem, I still can't figure it out yet.

But at least the plots that unfold from these videos themselves should not be included here.

For example, what everyone should be impressed by is that Jiang Qiuyi wears a black man's cosplay suit and needs to wear a bandage because it is too big. This only comes from the author's own plot creation and cannot be the facts told to me by Fei Fei himself.

The original plot based on the video is the essence of the book, not the video itself.

As for the videos of the two people's trumpets, most of them are original videos based on the plot of the book, and a small number of them are modified videos, including the devil aunt and love interaction.

As for Mom’s reaction, the Chinese Valentine’s Day video and some other short videos are all original.

——

4 Conclusion

I can't decide whether it's infringement or not.

If someone among book friends can contact the relevant up owner, you can also ask them to make their own judgment.

I won’t say anything about some parts that I’m not sure about, such as the specific definition and judgment criteria of text-infringing videos, such as the copyright ownership of barrage and comment areas, etc.

But some of them are indeed my own creative contributions, and I don’t want them to be overshadowed by a simple sentence of “Write the video of the up owner with a pen”.

I have written this so clearly, hoping that you will understand that it is my responsibility, and I will assume and apologize for it. Please do not impose it on me for any part that does not belong to me, and please respect the fruits of my labor.
